TERMS AND CONDITIONS

1.    MEMBERSHIP TYPES
Scottish Adventure Club (SAC) is made up of Personal Members, Business Members and Associate Members. The 'Scottish Adventure Club' or 'SAC' are the terms used to identify people and organisations which have purchased membership services from Scottish Adventure Club. 

 

Personal Members form a group of people with a passion for adventure sport in Scotland with exclusive access to our most sought-after adventure planning information, experiences, events, offers, opportunities to meet like-minded people and of course they are at the heart of our member-exclusive activities called Member Adventures.

Business Members are for-profit companies which provide products and/or services which either directly or indirectly help make adventure happen in Scotland. 

​

Associate Members are not-for-profit organisations which either have an interest in adventure sport in Scotland and/or provide information and/or guidance, best practices relating to adventure sport and/or activities in Scotland. 

​

Scottish Adventure Club (SAC) provides membership services which members subscribe to by becoming a member. The collective of all members is known as the Scottish Adventure Club.

2.    PERSONAL MEMBERSHIP

The benefits of Personal Membership are 1) access to our Member Adventures app (Spond), 2) access to our Members Forum, 3) authorisation to use member-exclusive discounts only available to SAC Personal Members. Personal Membership allows Personal Members who are the legal parent / carer of the child(ren) can bring them to Member Adventures while accompanied by the Personal Member. The term 'child' is defined by the Children (Scotland) Act 1995 as anyone under the age of 18.  Any person aged 18 or over shall be classed as a Personal Member.

For the avoidance of doubt, only children who are accompanied by a Personal Member of SAC shall be permitted to attend any Member Adventure - no Personal Member means no child can attend. Membership is owned by the Personal Member and not the child / children.

Personal Members must update their profile at www.ScottishAdventure.org/account with the name(s) of the child /children before attending a Members Adventure. There is no additional membership charge for children associated with a Personal Membership.

 


3.    BUSINESS / ASSOCIATE MEMBERSHIP

The benefits of Business / Associate Membership are 1) a listing on ScottishAdventure.org giving information about the member organisation including contact details and a summary of products and services offered and any projects, 2) social media posts promoting the member organisation and 3) notification of early notification for event sponsorship opportunities.

Upon completion of the sign up process, Business / Associate Members must provide details about their business to enable marketing to take place. Requested information must be provided within 30 days from sign up. 

 

Business / Associate Members are bound by all other Terms in this document with the exception of  'Member Adventure Waiver' with relates to Personal Member only. Business / Associate Members do not have access to any Personal Member benefits.

Business Membership is available to for-profit businesses (sole traders, LLPs and limited companies with shares), Associate Membership is available to non-profit businesses (charities, associations, community interest companies, limited companies without shares).

​

For the avoidance of doubt, both Business and Associate Memberships have the exact same benefits. 

​


4.    GENERAL MEMBERSHIP TERMS
The registered user of th
e Membership is required to agree to these terms and conditions at the point of membership purchase, purchasing any type of membership will automatically not be allowed to be completed unless these terms and conditions are accepted. 

​

Your membership will continue until terminated by you. Membership shall start on the date you join and will remain in place for the duration of your membership until terminated by you. For the avoidance of doubt, the sale contract begins on the day you join and does not renew on the billing cycle anniversary, this shall be considered a continuation of membership services.

 

To use the SAC Membership service you must have registered via the website and provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your membership before your billing date, you authorise SAC to charge the membership fee for the next billing cycle to your Payment Method.

We may offer a number of membership plans. Some membership plans may have differing prices which will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your SAC membership by visiting the www.ScottiahAdventure.org website and clicking on the "Account" link available at the top of the pages under your profile name.

​

Following the activation of a Membership, SAC shall only communicate with the registered Member via the email address used for their ScottishAdventure.org account associated with membership.

​

A Member must be subscribed to SAC marketing emails and communications to receive emails associated with their Membership benefits, such as welcome email, news, early access notifications and details of upcoming member-exclusive products. If you are uncertain of your subscription preferences, please contact info@ScottishAdventure.org.

Members must be over 18 years old to join. People under 18 cannot own any memberships but may attend Member Adventures if accompanied by a Personal Member.

​

Membership is dedicated to each Member, and the benefits of membership are for individual use only. Breach of this condition will result in the member being removed from the organisation. This includes and is not limited to member-exclusive products.

 

Members must not sell or gift SAC Member-exclusive products to non-members. Breach of this condition will result in the member being removed from the organisation.

 

To help ensure availability for all members, Member-exclusive products, including Special Editions are subject to order restrictions, ensuring products are for personal use only.

 

Membership is not transferable and shall not be transferred or re-sold. Those wishing to transfer membership purchased for the incorrect account should send their request to info@ScottishAdventure.org for consideration.

 

When seeking to use the benefits of Personal Membership, a member may be required at any time to show their in-app Membership status for inspection by SAC Committee Members or Business Members.

 

SAC reserves the right to suspend the use of Membership and/or any associated benefits for a period of time, to withdraw its use and such benefits completely and/or to cancel Membership if the Member breaches any of our terms and conditions or policies (or SAC has reasonable grounds to suspect such a breach) or otherwise misuses the Membership; SAC shall not be obliged to make any refund to a Member if their Membership and/or any associated benefits are suspended or withdrawn or if their contract for the purchase of a Membership is terminated.

In the event of any debate, the SAC Committee shall vote on any action to be taken. The SAC Committee's voted outcome(s) shall be final and there is no route to appeal. 

 

SAC reserves the right from time to time to alter, withdraw and/or substitute replacement events or benefits as part of Membership in place of any events or benefits advertised in promotional material.

 

SAC reserves the right to re-brand or re-name any membership products and benefits at any time.


Access to Personal Member benefits does not guarantee availability.

 

SAC shall be entitled to refuse an application from or suspend or cancel the Membership of any Member in its absolute discretion.

 

SAC operates zero tolerance of behaviour that is abusive, sexist, racist or harassment in any way. Reported incidents of this nature will be taken seriously and may be reported to authorities and will result in the termination of your membership without refund with a ban the duration of which shall be determined by the SAC Committee. 

 

Personal Members are expected to conduct themselves with respect and courtesy for others, treating others in the way they would wish to be treated themselves, this extends to online platforms such as the Member Forum, the Spond App and SAC social media channels.

SAC reserves the right to delete content, withhold access or impose a total ban on access to the Member Forum, Spond App and/or WhatsApp Groups should a member not conduct themselves in accordance with the above.

 

Nothing in these terms and conditions guarantees a member will be entitled to renew their Membership. Once expired, all rights and benefits of Membership will cease.

 

SAC collects personal information when an individual becomes a member, or when Members use services or products that require the collection of personal information. 

 

SAC will use this information to provide the services requested, maintain records, notify Members of important information regarding an individual’s membership (such as renewal notices), develop the organisation and send the Member information on things that may be of interest to them.

SAC shall not have any liability to a Personal Member for any late delivery of any materials resulting from the actions or omissions of any postal service provider.

 

SAC may, from time to time, update its Membership terms and conditions. Members are advised to refer to the Membership terms and conditions prior to the renewal of their Membership annually, copies available by going to www.ScottishAdventure.org .

 

These terms and conditions together with any associated application form/process comprise the entire agreement between SA and a Member in relation to the purchase and use of their Membership and replaces any previous terms and conditions of Scottish Adventure Club membership entered.

 

These terms and conditions shall be governed by and interpreted in accordance with the laws of Scotland and subject to the exclusive jurisdiction of the Courts of Scotland. 

 


5.    CANCELLATIONS

5.1.   Billing Cycle. 

The membership fee for a SAC membership subscription will be charged to your Payment Method on the specific payment date indicated on the "Subscriptions" page. The length of your billing cycle will be yearly. Visit the www.ScottishAdventure.org website and click on the "Subscriptions" link on the "Account" page to see your next payment date. Members control payment methods, not the Committee. 

5.2. Payment Methods. 

To retain your SAC Membership subscription you must provide one or more Payment Methods. You authorise an automatic charge from any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. If a payment is not successfully completed due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may cancel your membership subscription including your access to any / all member-exclusive benefits with immediate effect. If you wish to regain access to your member-exclusive benefits, you must purchase a membership again via the www.ScottishAdventure.org website.

5.3.   Updating your Payment Methods. 

You can update your Payment Methods by going to the "Account" page of your profile on the www.ScottishAdventure.org website. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorise us to continue to charge the applicable Payment Method(s).

5.4.   Cancellation. 

You can cancel your SAC membership at any time and you will continue to have access to the member-exclusive benefits until the end of your  current billing cycle. Payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unused benefits. To cancel, go to the "Account" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically close at the end of your current billing cycle. To see when your account will close, click "Subscriptions" on the "Account" page. 

 

5.5    Cancellation due to breach of terms and conditions 

If a member is found to have breached Membership Terms & Conditions or Communications & Social Media Policy, membership access can be cancelled with immediate effect by decision of the SAC Committee. All access to SAC communication channels and social media channels can be removed and/or blocked depending on the nature of the breach and access to any www.ScottishAdventure.org member-exclusive areas will be removed. The removed member will not be allowed to apply for new membership for a minimum of 6 months. Once cancelled, there are no further routes of appeal. Depending on the severity of the incident, the member could be subject to a life-time ban.

6.    MEMBER ADVENTURE WAIVER
The Terms and Conditions detailed below apply to all Personal Members participating in a SAC Member Adventure. By becoming a Personal Member is acknowledgement of acceptance of these Terms and Conditions. For the purposes of this document, the Personal Member is responsible for ensuring any children under their care also comply with this waiver.

Member Adventures are organised by Personal Member of the Scottish Adventure Club. This does not constitute them being a ride leader of any kind and they hold no responsibility for any incidents during any Member Adventure.

 

The participant accepts that the activity they are entering into is not a race in any format. There will be no timed races and time records to complete the Member Adventure will not be taken. Anyone considered to be competing against others will be stopped from taking part and prohibited from attending any future Member Adventures. 

 

The participant acknowledges the inherent dangers and risks involved in participating in the activity. Risks may include, but are not limited to, collision with pedestrians or animals, vehicles, other people, or fixed or moving objects, and dangers arising from surface hazards, equipment failure, weather, inadequate safety equipment, use of equipment or materials provided by SAC or the participant.

 

The participant acknowledges that these risks may be caused by the participant’s own actions, or inactions, the actions or inactions of others participating in the activity, the area, and conditions in which the activity takes place, and/or the participant’s own negligence or the negligence of others, whether or not known or reasonably foreseeable at this time. The participant undertakes to use good judgment and acknowledges his or her duty of care to other people around them.

 

The participant accepts and assumes all risks and is fully responsible for his or her actions whilst attending the Member Adventure. SAC does not accept responsibility for the actions of the participant nor the consequences of such action.

 

Each participant is responsible for providing his or her own insurance protection for his or her participation during the Member Adventure. Any fees paid, where applicable, do not include any insurance protection for accident, incident, sickness, or negligence of any individual participant. Any incident or injury caused by any participant’s actions will be the full responsibility of that participant.

 

Each participant is responsible for any fees or costs incurred or arising from an accident either involving or caused by the Personal Member. This includes, but is not exclusive to, fees from police, fire, ambulance, coastguard or any similar service such as a mountain rescue service. If the situation arises that the participant is not capable of making the decision to call the emergency services, or fails to do so for any reason, the participant agrees that a member of SAC or a member of public may call for them. In this situation, the participant still accepts the costs and consequences of such action.

 

The participant releases and discharges his or her right to sue SAC and/or its administrators, directors, agents, officers, volunteers and employees, other participating event organisers, any sponsors, advertisers and, if applicable, owners and lessors of premises on which the activities take place from all liability, claims, demands, losses or damages on the participant’s account, now or hereafter accrued, which are caused or alleged to be caused in whole or in part by the participant’s involvement in, association with or travel to and from the activity, including the participant’s negligence and the negligence of other participants.

 

Each participant, upon registering for any Member Adventure, agrees that they are physically and mentally capable of taking part, are free from any illness or medical condition that would prevent them from taking part and are of a level of fitness to participate in the distance prescribed prior to the Member Adventure commencing. If, during the Member Adventure, the participant decides to change route and/or distance then they do so at his or her own risk.

 

The participant accepts that instructions and routes may deviate at the time of the Member Adventure based on access, weather or other factors identified by the Member Adventure organiser.


Member Adventure registration must be completed by a person aged 18 years or over via our Spond App. Evidence of age may be requested by the organiser to verify Personal Membership.

 

While taking part in Member Adventures, whether wearing SAC Member Kit or otherwise, members are representing the brand and will extend their respect and courtesy to other trail / path / river / area users and to the public in a positive way.

​

The wearing of helmets is mandatory for all Member Adventure bike rides, this extends to any ride where SAC Member Kit is worn. The official Scottish Adventure Club Member Kit is blue a light blue contour design and orange detailing, being the jersey registered with British Cycling. 

 

For safety, members are asked to keep their adventure equipment including Personal Protective Equipment in good working order and for most rides, to use a bike and accessories which are appropriate for the terrain being ridden. Please check with the Member Adventure organiser for information on what bike is appropriate before the ride.

 

If part of the Member Adventure will be on public roads, the participant must be aware of this prior to leaving the ride Rendezvous Point. If the participant has any concerns regarding the route and cycling on public roads, then they should not participate at all. Points along the route may not be marked so it is important that the participants stick to the group they are riding with. 

 

The participant agrees that failing to complete the Local Adventure while at the agreed Rendezvous Point or informing the Member Adventure organiser may result in a search being organised and the subsequent costs will be billed to the participant.

The participant agrees to the use of his or her personal data in accordance with the SAC privacy policy.

 

The participant grants SAC the irrevocable and unrestricted right and permission to use, re-use, publish, and re-publish his or her image, likeness, name and/or biographical information in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, or reproductions thereof in colour or otherwise, made through any medium, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever.

 

The participant acknowledges that other terms and conditions and agreements may apply in addition to the attached including waivers, releases, or liability agreements and, potentially other terms. Any such other terms and conditions or agreements will apply in addition to, and shall not supersede, replace, or otherwise affect these Terms and Conditions.

 

The participant understands that nothing in these Terms & Conditions shall limit or exclude SAC’s liability for: (a) death or personal injury caused by its negligence; (b) any other matter in respect of which it would be unlawful for SAC to exclude or restrict liability. The participant also agrees however that in the event SAC is found to be liable, in no circumstances will SAC’s liability exceed £10,000.

 

These Terms & Conditions shall be governed by Scottish law and the courts of Scotland shall have exclusive jurisdiction in respect of the same.

 

All participants voluntarily give consent and expressly agree to all these Terms and Conditions as set forth above.

 

By becoming a SAC Member, you agree that you have read, understand, and expressly agree to the above agreement and terms and conditions.
